1. Fresh baked cakes are available only after 11 am from bakeries. Thus fresh baked cake can only be delivered after that time. In case of early morning delivery on the request of customer, we may get the cake a day prior to the date of delivery and keep it in refrigerator for early next day delivery. But we do not advise this.

2. Images shown here are indicative. We do our best to give better result than shown. It may be possible that actual arrangement/design/color of some items like flowers, cakes, sweets, cycles, refrigerators etc. varies due to seasonal or market availability or other reasons beyond our control. In such case, we shall substitute with available best quality product of equivalent value. We always ensure full or higher value to our customer in all such cases.

3. Delivery within city limit is free of cost. If any order is placed for some remote locations or beyond city limits of any town or village, a link will be sent to you asking for extra delivery charges if required. We will keep your order on hold for 5 days till we receive any update from you. After that your order will get cancelled with full amount refund and the same will be intimated to you via email.

4. Depending on delivery location, delivery schedule may be altered from same day delivery to delivery within 1 to 3 business days excluding the date of order. Holiday in between may extend it further.

5. Order received after 4 pm IST shall normally be processed as next day order, but we shall try our best to deliver the same day. For same day delivery of any urgent order placed beyond cut off time, a phone call would be appreciated to fulfill such urgent order. 

6. In case of any dispute related to the quality or difference in product delivered, the customer may raise a complaint within 48 hours on receiving the product along with the image of the product and valid reason for complaint. Decision of refund or redelivery can be taken depending upon the nature of complaint but any decision is sole prerogative of KolkataFlorist.in.    

7. We can ensure delivery on scheduled date but we do not provide any assurance for delivery at any specified time. Although we try our best to match our delivery with your preferred time but we do not provide any assurance for that. Some items like Leather Bags, Toys, Watches, Apparels etc are essentially delivered through courier and we make sure they are dispatched from our end well in time. We shoulder the responsibility of delay in dispatch from our warehouse but if the same happens at the logistic partners end then we are not responsible for that.

8. If there is no mention of delivery date on the order, we shall assume it for same day delivery. The order will be then processed and dispatched within 24 hours.

9. Shipment of product may be delayed due to floods, heavy rainfall, strike or any other such reason beyond our control. In such case KolkataFlorist.in shall do all coordination to deliver the product at the earliest. 

10. Full amount will be refunded in case we are unable to deliver your order. Apart from this, we shall not be liable for any loss of profits, emotional stress or any other liability etc. arising due to non-delivery.   

11. In case a customer wants to cancel an already placed order he needs to do it at least 24 hours before the date of delivery or the date of shipment. However in all such cases 7% of the ordered amount will be deducted towards credit card processing expense. Further if a customer wants to make any changes in the order, he has to do it 1 day prior to the date of delivery that too between 8 am to 8 pm. 

12. Prices of items subject to MRP restrictions are being sold on our website after adding the service charges, delivery charges and online transaction costs. Break-up of such components cannot be shown due to technical bindings.

13. We reserve the right to cancel any order without providing any reason regardless of any payment made otherwise. In such case ordered amount will be refunded back to the customer.

14. Respective brand owners are solely responsible for the quality of the products. You may lodge complaints on them through us, if the quality of product is not found up to the mark.

15. In case of delivery of some perishable products such as cakes, flowers, sweets or chocolates, if the delivery is not executed due to incorrect or incomplete address, premises being locked, refusal to accept the order or recipient not found at home. In any of these cases, we shall treat the order as delivered and no refund would be made against such order. However we always try to contact the recipient to take an appointment before executing delivery.

16. We sell Non-alcoholic Wine, Champagne and Sparkling Wine only. 

17. If due to any reason what so ever, money has not been realized against any processed/delivered order, the customer and the recipient shall be equally liable to compensate for the due amount. But if the customer and the recipient refuse to pay, we reserve the right to go for legal proceeding to realize the due amount. In case any Octroi or similar charges are levied by the state of the recipient, it has to be borne by the consignee.

18. Trademarks/Logo of products sold on our website belongs to the respective owners or companies.

19. All claims are subject to the jurisdiction of local court of Siliguri, West Bengal only.

20. While executing an international order, some extra charges like taxes or duties may be levied by the custom department of recipient’s country. Such charges will have to be borne by the customer/recipient and we shall not be held responsible for non delivery of such orders.  

21. All the consignments are dispatched as per your order.  But clearance at respective countries customs counter will have to be borne by you and we shoulder no such responsibility.

22. For delivery at Hotels, Hostels & Hospitals, POD signed by security personnel or at the reception will be considered a valid proof of delivery. However, we try our best to deliver the order to actual intended recipient. But we cannot assure that at these places due to reasons beyond our control. Further, if the delivery boy is stopped at the premise gate of any of these locations we try to get in touch with the recipient. But for some reason if the phone goes unanswered we consider it as an attempted delivery.

23. Under any circumstances, our merchant HDFC Bank shall not be liable for any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring Bank from time to time.

24. Irrespective of delivery date mentioned in the order, all Rakhi orders will be delivered at an earlier date due to heavy traffic during Rakhi.

25. By accepting our T&C, you also accept to receive all our notification, newsletters, communication matters, promotional matters etc. through various media channels. However, we ensure that we do not share any customer data with any outside agency group.
